The terms “us”, “we”, “Company” and/or “Holidaybuddie”/ “Naturforsker” refer to Holidaybuddie.com the website and Holidaybuddie App you are using or to Naturforsker, the company that owns and operates it. Together you and Holidaubuddie may be referred to as the “Parties” or separately as “Party”.
By using Holidaubuddie.com (the "Website"), the Holidaybuddie mobile app (the "App"), or any other Holidaybuddie platforms or services (collectively, the "Service" or "Services"), you agree to this Agreement. This applies to all users, regardless of registration or subscription status. The usage of Hoidaybuddie.com is bound by the Terms of Use set by Holidaybuddie. This Agreement is an electronic contract that establishes the legally binding terms you must accept to use the Service. Your use of our Services is also governed by the Privacy Policy, Cookie Policy, Payment Policy, Community Guidelines, Safety Tips, and any terms you agree to when purchasing additional features, products, or services ("Additional Terms Upon Purchase"). 13. Your Right to Use Our Services
While you follow these Terms, you have permission to use Holidaybuddie's Services. Holidaybudie grants you a personal, worldwide (Except, in countries where we do not operate. See restricted countries), royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use our Services for purposes as intended by Holidaybuddie.com and permitted by these Terms and applicable laws. If you violate these Terms, this license and your access to the Service will be automatically revoked.

Holidaybuddie offers products and services for purchase, including subscriptions and friend request boosters. Kindly view Product page to know our subscription & booster fees. Basic registration is free under our standard plan with limited features. Under the standard plan, Friend request boosters are free for 10 requests only. Additional friend request booster is available as per price mentioned in Product page. The Premium subscription plan is a paid service. Kindly view Products page for price. Premium comes along with 25 free friend request boosters. Additional friend request booster is available as per price mentioned in product page.
17. Internal purchases
Internal Purchases and Subscription Management. All Holidaybuddie users will pay through Paypal to Naturforsker, our parent company.
17.1. Payment Process:
For internal purchases, including subscriptions, use the Payment Method provided on our website or App. You have the option to pay through Paypal for the chosen subscription plan.
You agree to pay the displayed prices plus any applicable taxes.
You authorize Holidaybuddie to charge your chosen payment method for these amounts.
Holidaybuddie may correct billing errors even after payment.
17.2. Subscription Renewals:
Unlike other auto-renewing subscriptions, we do not automatically renew or charge you without your explicit consent. You will need to confirm renewal by clicking the renewal page or button. If you choose not to renew, your subscription will simply expire without any further charges. Renewals are entirely at your discretion.
After the initial period, renewals will continue at the agreed price and duration.
17.3. Changes in subscription & renewal prices and policies
Holidaybuddie may change the price of subscription, renewals and friend request boosters from time to time based on future requirements.
17.4. Cancellation:
To cancel payments, you can login to your paypal account and cancel a pending payment. If the payment is already completed, you cannot cancel it directly; you will need to request a refund. Refunds are subject to refund policy. View refund policy.
When you cancel, the subscription won't renew after the current term expires.
17.5 Payment Issues:
If a payment fails, you are still responsible for unpaid amounts. The subscription or friend request boosters will not be activated till the payment is successful.
17.6. Payment Method Updates:
You can edit Payment Method information in your paypal settings
Additional Notes:
Payment terms may be affected by agreements with your financial institution.
17.7. Chargebacks:
Initiating a chargeback may result in immediate account termination.

Important Notes:
Cancelling or non continuation of a subscription does not delete your profile from our Services.
To fully delete your account, go to settings and delete account.
18. Pricing and Promotions:
Our pricing varies globally based on multiple factors.
We offer promotional rates that may differ based on region, subscription length, bundle size, purchase history, account activity, and other factors.
We regularly test new features and payment options.
19. Refunds
All Internal as well as External purchases and subscriptions are typically final and Non-refundable. We do not encourage or allow refunds once your payment is completed under a plan subscription or for any additional service or friend request boosters under the plans. However, certain special refunds will be considered at the discretion of our company and legal laws.
Special refund terms apply in certain jurisdictions, including the EU, EEA, UK, Switzerland, Korea, Israel, and specific U.S. states such as Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, and Wisconsin.
19.1. Refunds Based on Jurisdiction
For EU, EEA, UK, and Switzerland Residents
You are entitled to a full refund within 14 days of starting your subscription, as required by local law. This 14-day period begins on the subscription start date.
19.2. For Subscribers in Germany
You may cancel your subscription after its renewal with one month's notice. Your right to cancel for cause remains unaffected.
19.3. For Republic of Korea Residents
In line with local regulations, you can receive a full refund for your subscription or unused Virtual Items within 7 days of purchase. This 7-day period starts from the date of purchase.
19.4. For Residents of Certain U.S. States and Israel
Subscribers from Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island & Wisconsin may cancel your subscription without penalty within three business days from the subscription date. The same applies to subscribers from Israel.
19.5. In the event of death: Your estate is eligible for a refund of any unused subscription period.
19.6. In the event of disability: If you become disabled and can no longer use our services, you may request a refund for the unused portion of your subscription.

If you subscribed via Apple ID, refund requests must be directed to Apple, not Holidaybuddie.com.
Similarly, If you subscribed via Google Play, refund requests must be directed to Google pay and not Holidaybuddie.com

If you believe your intellectual property rights have been infringed by content on our platform, please submit a notification of alleged infringement ("Copyright Takedown Notice") containing the following information:

Identification of the copyrighted work(s) allegedly infringed. For multiple works, provide a representative list.
Identification of the allegedly infringing material, including sufficient information for us to locate it on our platform.
Your contact information (address, phone number, email).
A statement of your good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

This includes, but is not limited to, loss of profits, loss of goodwill, data or program corruption or breaches, service interruptions, and procurement of substitute services - even if the company has been advised of the possibility of such damages.
Notwithstanding anything to the contrary, the company's liability to you will always be limited to the amount you have paid, if any, for the service while you have an account, regardless of the form of the action.
The user agrees not to hold Holidaybuddie.com or its parent company Naturforsker responsible for content or actions of other users. As most of the content on Holidaybuddie comes from users, the company does not guarantee the accuracy of profile information, user communications, or the quality, safety, and legality of what is offered.
Continuous or secure access to Holidaybuddie's services cannot be guaranteed. To the extent legally permitted, Holidaybuddie expressly disclaims all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, and fitness for a particular purpose.
Holidaybuddie and Naturforsker are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising from the usage of the Holidaybuddie.com website or Holidaybuddie APP
24. Safety Disclaimer and Limitation of Liability
HolidayBuddie is a platform that facilitates social networking, meetups, and dating connections. While we encourage safe and respectful interactions, users are solely responsible for their conduct both on and off the platform.
24.1. No Liability for Member Conduct HolidayBuddie does not assume any legal responsibility for the actions, behaviour, or conduct of any user—including acts of violence, sexual harassment, sexual assault, rape, or any other criminal or unlawful activity—that may occur before, during, or after meetings arranged through the platform.
24.2. No Agency or ControlHolidayBuddie.com does not control or supervise in-person interactions between members and makes no guarantees about the character, intentions, background, or conduct of any user. All users are advised to exercise personal judgment and follow recommended safety practices.
24.3. Independent Legal Action If any user is subjected to or witnesses unlawful behaviour (including but not limited to sexual harassment, assault, or violence), they are encouraged to report the incident to the appropriate law enforcement authority in the jurisdiction where the incident occurred. Affected users have the full right to pursue civil or criminal action against the individual responsible, without involving or implicating HolidayBuddie.com, except where explicitly required by applicable law.
24.4. Jurisdictional Application. This clause shall be interpreted in accordance with applicable laws in the country where the incident occurred or where the affected party resides.HolidayBuddie.com will cooperate with law enforcement agencies if required by law but shall not be held liable for user conduct beyond its platform boundaries.
25. Indemnity by You
The Company reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you. In such cases, you will fully cooperate with the Company in connection therewith.
26. Disclaimer of warranties and liabilities
Use of this website indicates your acceptance of these terms. If you disagree with any part of this disclaimer, please do not use our services.
27. Dispute Resolution
In the unlikely event that a legal dispute arises, here is how the parties agree to proceed, unless prohibited by applicable law:
27 1. Governing Law
This Agreement and any dispute or claim arising from it shall be governed by the laws of India, unless overridden by mandatory consumer protection laws applicable in your country of residence.
27.2. Jurisdiction
Subject to Clause 3 (Arbitration), courts located in Chennai, Tamil Nadu, India shall have exclusive jurisdiction over disputes, unless otherwise required by applicable local law.
27.3. Arbitration
Except for claims specified in Clause 4, disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996, with the following terms:

27.4. Exception – Sexual Assault or Harassment Claims
Individual claims involving criminal offence in nature,violence, sexual assault or sexual harassment connected to the use of HolidayBuddie shall not be subject to arbitration. Such claims may be brought before a civil or criminal court, as applicable under local law.
27.5. Content-Related Disputes
Disputes concerning content (e.g., offensive, defamatory, impersonating, or infringing material) should first be reported to Holidaybuddie’s content moderation team. Unresolved disputes after 15 days may proceed under arbitration or court, depending on their nature.
27.6. Data Privacy Disputes
EU Users: Subject to GDPR; you may contact your Data Protection Authority.
U.S. Users: Subject to CCPA and other applicable state privacy laws.
Other International users can contact their country’s data authority.
HolidayBuddie shall cooperate with regulators and users in good faith.
27.7. Cross-Border Jurisdiction (EU/US Users)
EU Residents: May also bring claims in their country of residence under local consumer protection laws.
U.S. Residents: This clause does not override non-waivable rights under state laws such as California’s CCPA.
In case of a legal conflict, mandatory consumer protections override.
27.8. Class Action Waiver
To the fullest extent permitted by law, all disputes shall be resolved individually, and not as a plaintiff or member in any purported class, collective, or representative proceeding.
27.9. Interim and Injunctive Relief
Either party may seek interim or injunctive relief before a court of competent jurisdiction (in India or internationally) to prevent misuse of the service, protect safety, or defend intellectual property.
27.9a. Fees and Costs
In arbitration, each party shall bear its own legal fees and costs unless otherwise awarded by the arbitrator.

28. Informal Dispute Resolution Procedure
If for any reason you are dissatisfied with our Service, please first contact Holidaybuddie support at support@holidaybuddie.com to help resolve your issue without outside assistance. If you decide to pursue a dispute, claim, or controversy against Holidaybuddie, we will notify you of the process and these Terms will apply. For purposes of this Dispute Resolution Procedure and the arbitration procedures, “Holidaybuddie” includes its affiliates, employees, licensors, and service providers.
28.1. Holidaybuddie values its relationship with you and appreciates the mutual benefit that can be gained through informal dispute resolution. “Dispute” means any dispute, claim or controversy between you and Holidaybuddie arising out of or relating to this Agreement (including your alleged breach of this Agreement), the Services or your relationship with us. As used in this Agreement, “Dispute” has the broadest meaning and includes claims that arose before this Agreement or any prior Agreement existed, as well as claims that arose during the term of this Agreement or after the termination of this Agreement (unless this Agreement is superseded by a subsequent agreement between you and Holidaybuddie). If you have a dispute with Holidaybuddie (“Your Dispute”), before your Dispute is formally resolved in arbitration or small claims court, you agree to first provide Holidaybuddie with detailed notice (“Notice”) by email and postal mail, India.
28.2. Your Notice must include all of the following information: (1) your name; (2) information that allows Holidaybuddie to identify your account, including your profile picture or screenshot, your address, mobile phone number, email address, and the date of birth (if available) you used to register your account; (3) a detailed description of your dispute, including the nature and factual basis or proof for your claim, and the relief you seek. This notice must be signed by you in order to be effective.
28.3. You and Holidaybuddie agree to negotiate in good faith to resolve the Dispute. As part of such good faith negotiation, you and Holidaybuddie may participate in an electronic or telephone conference to discuss your Dispute, and if you are represented by an attorney, you agree to participate in person with your attorney.
28.4. In the event of a Dispute with you (“Holidaubuddie Dispute”), Holidaybuddie agrees to first send notice to your last email address on file in our database, or, if no email address is on file in our database, to other contact information associated with your account.
28.5. Likewise, you may request a conference call to discuss your dispute with Holidaybuddie, and Holidaybuddie agrees to have one representative. Disputes must be resolved through this informal process. However, if the dispute is not resolved within 60 days after receipt of the fully written notice, and the parties have not otherwise agreed to extend this informal dispute resolution period, you or Holidaybuddie may initiate arbitration at the courts of Chennai, India as mentioned in the dispute clause no 27.
28.6. Completion of this informal dispute resolution is a prerequisite to filing a claim in arbitration or litigation in the court of Chennai, India (except for individual claims of sexual assault or sexual harassment arising in connection with your use of the Services). Failure to do so will be deemed a breach of this Agreement. The court of competent jurisdiction is Chennai, Tamil Nadu, Indi and they will have the power to enforce this provision and bar any arbitration or small claims court action accordingly.
28.7. Confidentiality: The parties shall maintain confidentiality, and either party may submit a dispute to the arbitrator only through written statements. Confidential information may not be used or disclosed in any other forum or for any purpose other than the purpose of the arbitration proceeding.
28.8. Court Hearing: You and Holidaybuddie have the right to a fair evidentiary hearing (i.e., trial) before the courts of Chennai, India. Both parties must appear in person or through legal counsel at the hearing on the agreed date and time.
28.9. You and Holidaybuddie acknowledge and agree to act in good faith to fairly resolve bona fide disputes.
29. Force Majeure
To the extent permitted by applicable law, HolidayBuddie shall not be held liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from events beyond HolidayBuddie's reasonable control. Such events may include, but are not limited to:
natural disasters (e.g., floods, earthquakes),
pandemics, epidemics, or government-imposed health restrictions,
war, terrorism, armed conflict, or civil unrest,
legal or regulatory changes (including those under the EU Digital Services Act),
strikes, labour disputes, or supply chain disruptions,
internet or telecommunication outages, or
failure of third-party service providers or platforms.
During any such event, HolidayBuddie’s affected obligations shall be suspended for the duration of the disruption. HolidayBuddie will make commercially reasonable efforts to minimize the impact of such force majeure events and to resume Services as soon as possible.
30. Miscellaneous
These Terms, together with the Privacy Policy, Cookie Policy, Community Guidelines, Safety Tips, and any Additional Terms applicable to purchases, constitute the entire agreement between you and HolidayBuddie regarding your use of the Services, and supersede all prior agreements, understandings, or arrangements, whether written or oral.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
HolidayBuddie’s failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
You acknowledge that your HolidayBuddie account is non-transferable, and that all rights to your account and any associated content terminate upon your death, unless otherwise required by applicable law.
Any rights or licenses granted to you under these Terms may not be assigned or transferred by you, but may be freely assigned by HolidayBuddie without restriction.
Nothing in these Terms shall be construed to create a partnership, joint venture, agency, fiduciary, or employment relationship between you and HolidayBuddie. You agree that you have no authority to bind or represent HolidayBuddie in any manner.

By using our Services, you accept the Terms of this Agreement.
By using our Services, whether through a mobile device, mobile application, or computer, you agree to be bound by the following:
(i) These Terms, which we may amend from time to time.
(ii) Our Privacy Policy, Cookie Policy, Community Guidelines, Safety Tips and all other terms mentioned above.
(iii) Any Additional Terms Upon Purchase.
If you do not accept and agree to be bound by all of the terms of this Agreement, you are not entitled to use our Services.
